Zoning Board of Appeals Minutes May 2, 2007
MEMBERS PRESENT: Peter Conner, William Keohan, Michael Main, David Peck, Marc Betti,  A. Wendy Longo and Robert Richard.

Mr. Conner called the meeting to order and explained procedures for the evening.

CASE NO. 3416– A. CHARLES CARANCI – off PINEWOOD ROAD

Sitting: Peter Conner, David Peck, A. Wendy Longo, Robert Richard, and Marc Betti.

Mr. Richard read the legal advertisement into the record.

Mr. Shaw, Associated Engineering, representing the petitioner said that the property is off Route 44 approximately 2 miles from the Carver line on Narragansett Pond.  The pond is 8’ deep.  Approximately 60,000 cubic yards will be removed instead of 115,000 cubic yards.  The sight distance is straight.  During the summer months busses drive in the area going to the winery.  The preferred route would be Route 44 to Pinewood Road.

Attorney Angley, representing the petitioner, referred to a written presentation on file in the ZBA office.  P. A. Landers will do the excavation.  Narragansett Pond will be restored to its original size except in the westerly portion.

Mr. Richard asked the petitioner if he would consider waiting until after the tourist season to start the excavation.

Mr. Caranci replied that he would.

Mr. O’Reilly asked the Board to consider conditioning the permit that the empty trucks go through the mobile home park and out through Pinewood Road.

No public comment was offered in opposition.

Mr. Shaw said that the major entrance is a the cul-de-sac

Mr. Caranci said when you get to the clubhouse the hill is very steep.  It would be difficult for trucks to use.

CASE NO. 3417 – MAGNUM DEVELOPMENT – SEVEN HILLS ROAD

Sitting: Peter Conner, William Keohan, David Peck, A. Wendy Longo, and Robert Richard.

Mr. Richard read the legal advertisement into the record.

Mr. Handy, GAF Engineering, representing the petitioner, said the request for the front setback is no longer required.   An access drive moved to the north.  The dwelling moved back on the site.  The lot line being changed 20-ft. in a northerly direction will be handled by a Form A.  Stormwater mitigation will be addressed.    

No public comment offered.

CASE NO. 3405 – S & C CONSTRUCTION – BRALEY LANE

Sitting: Peter Conner, William Keohan, David Peck, Michael Main and Marc Betti.

Mr. Conner closed the public hearing.

Mr. Main made a motion to approve Case No. 3405 with conditions.

Mr. Peck seconded.

Unanimously granted.

Mrs. Longo made a motion to grant Case No. 3416 with conditions.

Mr. Richard seconded.

Unanimously granted.

CASE NO. 3417 – MAGNUM DEVELOPMENT – SEVEN HILLS ROAD

A long discussion ensued between Board members regarding the site improvements for the driveway.

Mr. Richard made a motion to approve Case No. 3417 with conditions.

Mr. Peck seconded.

Unanimously granted.

No further business came before the Board.
